Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and NutriLogic Labs Inc. (“EatSure,” “we,” “us,” or “our”). By creating an account, downloading the app, or otherwise using the EatSure mobile app, eatsure.app website, or backend services (collectively, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

EatSure reads nutrition labels against your personal food profile and helps you track grocery purchases against publicly available FDA and USDA food recall data. You can scan a label for a personal fit verdict, scan paper receipts, browse the recall database, save items, and receive alerts when something you've bought is recalled.

EatSure is an information tool. It is not a substitute for medical, legal, or professional advice, and we do not guarantee that recall information is complete, accurate, or up to date — see Disclaimers below.

You must be at least 13 years old (or the equivalent minimum age in your country) to use EatSure. You're responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us right away if you suspect unauthorized access.

Core EatSure features are free. We may offer optional premium features through a paid subscription. Subscriptions are billed through Stripe, the App Store, or the Play Store, depending on how you signed up.

Subscriptions renew automatically at the end of each billing period unless you cancel beforehand. You can cancel any time through your App Store, Play Store, or account settings. Except where required by law, payments are non-refundable.

Prices may change. We'll give you notice before any price increase takes effect on your subscription.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Scrape, crawl, or bulk-extract data from the app or our APIs without written permission
• Interfere with, disrupt, or place undue load on the Service or its infrastructure
• Upload content that infringes intellectual property, contains malware, or violates anyone's rights
• Resell, sublicense, or commercially exploit the Service without our written consent

You retain ownership of the receipts, photos, lists, and other content you submit to the Service (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display Your Content solely to operate and improve the Service for you.

You're responsible for Your Content and for the accuracy of any data you enter. Don't upload anything you don't have the right to share.

The Service, including its software, design, branding, and content (excluding Your Content and public government data), is owned by NutriLogic Labs Inc. and is protected by copyright, trademark, and other laws. We grant you a limited, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

EatSure relies on third-party services to function — including Apple and Google sign-in, Stripe for payments, push notification gateways, cloud hosting providers, and the FDA/USDA public APIs. We're not responsible for the availability, content, accuracy, or practices of those third parties, and your use of them may be subject to their own terms.

EatSure is provided “as is” and “as available,” without warranties of any kind, whether express or implied.

Recall data is sourced from publicly available FDA and USDA databases and may be incomplete, delayed, or inaccurate. Receipt OCR may misread items. We make no guarantees that the Service will identify every recalled product you have purchased, that alerts will be delivered without delay, or that the Service will be uninterrupted, secure, or error-free.

EatSure is not a medical service and does not provide medical, dietary, or legal advice. If you believe you've been exposed to a recalled product, contact a healthcare professional and refer to the official recall notice.

To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, NutriLogic Labs Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service.

Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US $50.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless NutriLogic Labs Inc. and its team from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Service, or your infringement of any third-party right.

You can stop using EatSure and delete your account at any time from the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, the sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising from or related to the Service or these Terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

We may update these Terms from time to time. If changes are material, we'll notify you in the app or by email before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
